INTRODUCTION

We are a  company that uses new technologies and artificial intelligence to improve performance and cyclist safety.

This Privacy Policy and the Cookies Policy,  apply to the use of our website, application, services and device.


Notio Technologies Inc. (“Notio”) is a subsidiary of Cycles Argon-18 Inc. Based in Montréal, Canada, we aim to improve the performance and safety of cyclists. This Privacy Policy applies to our web site, to NOTIO® device, NOTIO ® iOS application, our Services and your NOTIO® cloud account (collectively designated “NOTIO® ecosystem”). All of these are owned and operated by Notio together with its subsidiaries and affiliates, which operate the online store ("Store") portion of the site, (collectively "We", "Us" or "our"). By using one of these, you are a party to the contract (license agreement) that allows you to enjoy the NOTIO® device, and by using it, you signify your agreement to this Privacy Policy and to the processing of your Personal Data; which is necessary for the performance of the NOTIO® device. If you do not agree with these terms, please do not use our Services, nor the NOTIO® device.

 

Changes to this Privacy Policy apply when you use our site or services as of the moment they are published.

We reserve the right to change, modify, add, or remove portions of this Privacy Policy at any time and at our discretion. If you have an account with Us, you will be informed by email or by a pop-up window of all modifications. If you do not have any account with Us, please consult the link entitled “Last update”. Your continued use of this site following the posting of changes to this Privacy Policy will signify your acceptance of the revised terms. 

Using new technologies and artificial intelligence, NOTIO® device records in real-time data, namely to calculate real-time CdA (Coefficient of Aerodynamic drag) and analyzes your performance, one ride after another.

Hence, as part of our transparency commitment to you, we hereby inform you of our Privacy Policy. You will find in this Privacy Policy the information on how to contact our data controller, what are your rights and how to exercise them, what data is collected, for what purpose are they processed, with whom We may share your Personal Data, how long We keep the data collected, how We secure data, where We store data, and where your data may be transferred. We remain focused on the protection of your privacy. As part of our design process, We conduct a privacy impact assessment to understand the purpose of the new/enhanced Services, the personal information that might need to be collected to fulfill that purpose, and the necessary step to ensure that the Personal Data is properly collected and processed.

INFORMATION WE COLLECT

You provide us with personal data to be able to use fully benefit from NOTIO.


NOTIO® Services are data-based. Therefore, in order to use our Services, and fully benefit from the NOTIO® device, you are required to provide Personal Data. If you do not, the result of the analysis offered by the NOTIO® device may be distorted or simply not be available.

 

We collect your personal data and performance data.


We collect two general types of information from you: (1) personal data (“Personal Data” is any information relating to an identified or identifiable individual, such as your name, email address, age, weight, etc.); which includes your performance data (physiological information, such as heartbeat, etc.); and, (2) aggregate data for statistical purposes (such as information about traffic patterns on this site; for example, by using cookies to know how many users log in to this site on a daily basis).

 

1. Personal Data

You provide us with data to create your account.


Personal Data is collected when users provide information to Us, for example in creating a cloud account with Us to benefit from the NOTIO® device, in registering for electronic newsletters or other membership services, in answering surveys, purchasing items from the Store, registering to bid on items available at an online auction, and/or registering for contests and other promotional opportunities provided by Us. When you register or request information on this site, We generally need you to provide your name, email address, mailing address, daytime phone number and credit card information (only when ordering products at the Store), as well as create a username and password. In addition, if you send Us personal correspondence, such as emails or letters, We may collect such information in a file specific to you.

NOTIO® device also records your physiological information, such as heartbeat, muscle oxygenation, etc. Once an activity is completed, you will be able to import the data for analysis by email, AirDrop or by connecting to NOTIO® iOS application (collectively Our “Services”).

All Personal Data collected by Us are information you agree to provide to Us to benefit from the NOTIO ® device and our Services. Your Personal Data collected may come from no other sources. 

You hereby consent to the processing of your Personal Data by Us in order to benefit from Our Services.

 

2. Aggregated Information and Usage Information

We also collect data from the devices you use such as IP address and URL, but you will remain anonymous to us.


Aggregate information, such as the pages users access and information volunteered by them, and such as survey information and/or site registration information, is collected through various methods. In the course of using Our site, We also automatically track certain information about you. This information includes the URL that you just came from, which URL you go to next, what browser you are using, and your IP address. An IP address is a number that is automatically assigned to your computer whenever you are surfing the web. Web servers, those computers that "serve up" web pages, automatically identify your computer by its IP address, and when you request a page from Us, our servers log your IP address. We do not link IP addresses to anything personally identifiable, so although you will be logged in, you will remain anonymous to Us.

We will always provide you with an opportunity to accept or decline our commercial electronic messages. DISCLOSURE OF COLLECTED DATA TO OTHER RECIPIENTS

TRANSFER TO OTHER COUNTRIES & STORAGE PERIOD

Provided that we are a Canadian-based company, Personal Data collected by Us may be stored and processed in Canada and in any country where our affiliates, subsidiaries or trusted third party service providers whom process data on our behalf, including countries outside the European Economic Area, namely in the United States. We will do this in order to fulfil our contractual obligations to you, or because it is in our legitimate interests to do so.

We have with these recipients contractual clauses or binding corporate rules, which guarantee the security and privacy of your Personal Data. We keep your Personal Data as long as your account is active and as long as needed to comply with our contractual and legal obligations.

We will only retain your Personal Data for as long as is necessary for the purposes described in this Privacy Policy and as long as your account is active or as needed to provide you with the requested Services. This means that the retention/storage periods will vary according to (a) the type of data, and (2) the purpose for which we have collected the data in the first place. We will retain and use your Personal Data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

You have the right to be informed about any new use of your Personal Data.

We bring any new uses of your Personal Data to your attention before We start the processing.

 

You can access and have a copy your own Personal Data upon request.

We have up to one (1) month of its receipt to respond to your request about the measures taken or the reasons for our refusal. You have the right to copy or transfer your Personal Data to another IT environment.

  • Right to data portability: The right to data portability allows you to obtain and reuse your Personal Data. It allows you to move, copy or transfer your Personal Data easily from one IT environment to another in a safe and secure way, without affecting its usability, and to receive Personal Data you have provided to Us in a structured, commonly used and machine readable format. You can also request that our controller transfers your data directly to another controller of your choice. Please note that this right to data portability only applies to your Personal Data, and not to anonymous data that cannot be linked back to you.

 

You can object to the processing of your Personal Data.

  • Right to object: You have the right to object to the processing of your Personal Data under certain circumstances depending on our purposes for processing and our lawful basis for processing. You have an absolute right to stop your data being used for direct marketing purposes at any time. You can make known to Us an verbal or written objection. We have up to one (1) month to respond to your objection about the measures taken or the reasons for our refusal.

  • Rights relating to automated decision making, including profiling: We may process your Personal Data to carry out automated decision-making and for profiling to allow you to fully benefit from our Product and Services .
